Foreign-Language Powers of Attorney and Apostille in Ontario: What Clients Need to Know Before Visiting a Notary Public
Preparing a Foreign-Language Power of Attorney for Apostille in Ontario: Best Practices and Common MistakesIf you need to use a Power of Attorney or another legal document in a foreign country, you may be asked to obtain an Apostille from Ontario Official Documents Services (ODS). Since Canada joined the Hague Apostille Convention in 2024, many international documents can now be recognized abroad through the apostille process.However, foreign-language documents often create confusion for clients. Questions frequently arise about translations, notarization requirements, and whether a Notary Public can certify the accuracy of a translation.This guide explains the process, available options, and important considerations before preparing a foreign-language Power of Attorney for apostille purposes.Step 1: Determine Whether Your Document Requires an Apostille Many countries that are members of the Hague Apostille Convention require an apostille before accepting a Canadian document.Common examples include:Powers of Attorney Real estate documents Corporate documents Affidavits and declarations Educational documents Immigration-related documents Ontario Official Documents Services (ODS) is responsible for issuing apostilles in Ontario. ODS does not review or approve the contents of documents. Instead, ODS verifies that the signature and seal appearing on the document match the records on file. Step 2: Understand the Requirements for Foreign-Language Documents Ontario has specific requirements for documents written in languages other than English or French.According to ODS requirements, foreign-language documents must generally:Be issued within Canada; Be notarized by an Ontario Notary Public; and Be accompanied by a translation. This is where many clients encounter difficulties.Translation Option 1: Certified Canadian Translator (Recommended) The safest and most widely accepted approach is to obtain a translation from a Certified Canadian Translator.A certified translator is a member of a recognized provincial translation association and certifies the accuracy of the translation. ODS specifically recognizes this option.Advantages Independent professional translation Reduced risk for the Notary Public Widely accepted by government agencies and foreign authorities Clear separation between translation services and notarial services For many international legal documents, including Powers of Attorney, this is often the preferred option.Translation Option 2: Translation Attestation by an Ontario Notary Public Ontario also permits another option.A Notary Public who speaks both English (or French) and the language of the document may attest to the translation and certify its accuracy. ODS specifically provides for this option.In such cases, the notary must state that:They speak English or French and the language of the document; and They certify the accuracy of the translation. Important Considerations While this option exists, clients should understand that it may not always be the preferred approach.When a Notary Public certifies the accuracy of a translation, the notary is making a positive statement regarding that translation. The notary is no longer simply witnessing a signature or verifying identity. Instead, the notary is also certifying that the translation accurately reflects the original document.This can create practical concerns where:The translation was prepared by the client; The translation was prepared by a third party who is not a certified translator; The document contains specialized legal terminology; The document contains technical language that may require professional translation expertise. For this reason, many notaries prefer that clients obtain a certified translation from a qualified translator rather than relying on the notary to certify the translation.Best Practice: Prepare a Bilingual Document In our experience, many foreign authorities, lawyers, and government agencies find it helpful when a Power of Attorney contains both:The original foreign-language text; and An English translation. A bilingual format often allows all parties to review the document more easily and can reduce confusion about the meaning of specific clauses.For example, some clients choose to prepare:Foreign Language English Translation Original text Corresponding English translation While ODS requires a translation, it does not specifically require a side-by-side format. However, bilingual formatting can often improve clarity and reduce the risk of misunderstandings. The receiving foreign lawyer or authority should always be consulted regarding their preferred format.Step 3: Visit an Ontario Notary Public Once the document is finalized and the translation is prepared, the next step is to visit an Ontario Notary Public.The notary may:Verify the signer's identity; Witness the signing of the document; Complete a notarial certificate; Affix their signature and seal. It is important to understand that a Notary Public does not generally provide legal advice regarding the contents of the document unless separately retained to do so.The document should be completed before the appointment and the client should bring valid government-issued identification.Step 4: Submit the Document to Ontario Official Documents Services After notarization, the document may be submitted to ODS for apostille.ODS verifies:The notary's signature; The notary's seal; That both match records maintained by ODS. ODS does not validate the contents of the document itself.Apostille will only proceed if the notarial signature and seal are clearly visible and can be verified.Common Mistakes That Cause Delays Missing Translation Foreign-language documents submitted without the required translation may be rejected or delayed.Incomplete Notarial Certificates A poorly completed notarial certificate or missing seal may prevent authentication.Relying on Informal Translations Translations prepared by friends, relatives, or online software may not satisfy foreign authorities or may create concerns regarding accuracy.Waiting Until the Last Minute Many real estate transactions, inheritance matters, and foreign legal proceedings have strict deadlines. Apostille processing should be planned well in advance.Final Thoughts If you are preparing a Power of Attorney or another foreign-language document for use outside Canada, careful preparation can save time, money, and frustration.In many cases, the most prudent approach is:Prepare the foreign-language document. Obtain a certified translation from a recognized Canadian translator. Attend before an Ontario Notary Public for notarization. Submit the notarized document to Ontario Official Documents Services for apostille. While Ontario allows a bilingual notary to certify the accuracy of a translation, clients should understand that this involves a higher level of responsibility than ordinary notarization. For many international documents, an independent certified translation may provide the clearest and most reliable path forward.New Horizons Notary Services assists clients throughout Toronto and the GTA with Powers of Attorney, affidavits, declarations, certified true copies, and other documents intended for use outside Canada.
Witnessing a Will in Ontario: Legal Requirements, Common Practice, and Mistakes to Avoid
A Guide for Ontario Clients Making a will is one of the most important steps in estate planning. However, even a carefully drafted will can create significant problems if it is not properly signed and witnessed.In Ontario, the legal requirements for witnessing a will are governed primarily by the Succession Law Reform Act (SLRA). In addition to these statutory requirements, lawyers and notaries commonly follow certain best practices to help reduce future probate difficulties and challenges to the validity of the will.This article explains:Who can and cannot witness a will in Ontario The legal requirements for valid execution Common mistakes made by testators and witnesses The role of a notary public during a will signing The purpose of an Affidavit of Execution Practical tips to help avoid probate complications What Does Ontario Law Require?For most formal wills in Ontario, the testator (the person making the will) must:Sign the will at the end of the document, or acknowledge their signature; Do so in the presence of two witnesses who are present at the same time; and Have those witnesses sign the will in the presence of the testator. These requirements exist to help ensure that the will genuinely reflects the wishes of the testator and to reduce the risk of fraud or undue influence.Who Can Be a Witness to a Will?Generally, a witness should be:

An adult with capacity;

Independent from the estate;

Not receiving a gift under the will;

Able to observe the signing process;

Available in the future if evidence about the execution of the will becomes necessary.

Although Ontario law does not require witnesses to be lawyers or notaries, independent witnesses are strongly recommended.Who Should Not Be a Witness?

Beneficiaries

One of the most common mistakes occurs when a beneficiary signs as a witness.Section 12 of the Succession Law Reform Act provides that where a witness (or the witness's spouse) receives a beneficial gift under the will, the gift may be void. Importantly, the entire will does not automatically become invalid, but the gift itself may fail.Example If a daughter is left $25,000 in her mother's will and also signs as a witness, that gift could be challenged and potentially declared void.Spouses of Beneficiaries The same concern applies to the spouse of a beneficiary.

A witness whose spouse receives a gift under the will may create complications under section 12 of the SLRA.

Individuals with a Financial Interest in the Estate Even where the legislation does not expressly prohibit a witness, using someone who has a financial interest in the estate may increase the likelihood of disputes or allegations of undue influence.

For this reason, lawyers and notaries generally recommend using completely independent witnesses whenever possible.Can an Executor Be a Witness? Yes.Section 14 of the Succession Law Reform Act provides that a person is not disqualified from proving the execution of a will merely because they are named as executor.However, many practitioners still prefer to use independent witnesses where possible.Can a Creditor Be a Witness? Yes.Section 13 of the SLRA confirms that a creditor is not automatically disqualified from acting as a witness solely because the estate owes them money.Does a Will Need to Be Notarized in Ontario? No.A common misconception is that a will must be notarized to be valid.Ontario law does not require a will to be notarized. A will becomes legally valid when it is properly executed in accordance with the requirements of the Succession Law Reform Act.Notarization is not what makes a will valid.The Role of a Notary Public During a Will SigningAlthough a will itself is generally not notarized, notaries and lawyers commonly assist clients with the execution process.Depending on the circumstances, a notary public may:

Verify the identity of the testator;

Verify the identity of the witnesses;

Ensure that the signing procedure is conducted correctly;

Confirm that all signatures are completed in the proper places;

Maintain professional records of the appointment;

Administer and commission an Affidavit of Execution;

Prepare certified true copies of the executed will when requested.

These services do not replace legal advice and do not determine the validity of the will, but they often help create a clear record of the signing process.Identity Verification: A Common Best Practice Although the Succession Law Reform Act does not specifically require government-issued identification before signing a will, lawyers and notaries commonly verify identity as a matter of professional practice.Identity verification helps establish:

Who signed the document;

That the correct individuals acted as witnesses;

That the execution process was properly conducted.

This documentation can become valuable years later if questions arise concerning the validity of the will.

What Is an Affidavit of Execution?One of the most important documents prepared after a will signing is the Affidavit of Execution.After the will is signed, one of the witnesses may swear an affidavit confirming:

Their identity;

That they witnessed the signing of the will;

That the testator signed or acknowledged the signature in their presence;

That the witnessing requirements were followed. The affidavit is then commissioned by a lawyer, notary public, or commissioner authorized to administer oaths.

 Why Is an Affidavit of Execution Important? The affidavit does not make the will valid.However, it is commonly used during estate administration because it provides evidence that the will was properly executed.Without an affidavit, an estate trustee may later need to locate the witnesses and obtain evidence regarding the signing process. This can become difficult many years after the will was signed.For this reason, lawyers and notaries frequently arrange for the Affidavit of Execution to be completed immediately following the signing appointment. Certified True Copies of a Will Clients occasionally request certified true copies of their signed will.A certified true copy is simply a copy that has been compared to the original and certified as a true reproduction.It is important to understand that a certified copy is not a replacement for the original will. The original signed will should be stored securely because the original document is often required during estate administration.Common Mistakes Made by Testators

Using Family Members as Witnesses

Many people ask a spouse, child, or beneficiary to witness their will. This can create unnecessary legal complications and may affect gifts under the will.

Not Having Both Witnesses Present The statutory requirements generally require both witnesses to be present at the same time when the testator signs or acknowledges the will.

Making Changes After Signing Handwritten changes made after execution can create uncertainty and litigation.Before making alterations to a signed will, legal advice should be obtained.Losing the Original Will A photocopy is not the same as the original will.Clients should store the original in a secure location and ensure that their executor knows where it is located.Common Mistakes Made by Witnesses

Not Actually Observing the Signature A witness should genuinely observe the signing process and not simply sign where instructed.

Signing at a Different Time Witnesses should not sign the document later unless the execution process complies with applicable legal requirements.

Failing to Keep Records Years may pass before a will is reviewed after death. Professional notes and records can assist in proving proper execution if questions arise later.

Remote Witnessing in Ontario Ontario law permits remote witnessing of wills in certain circumstances using audio-visual communication technology, provided statutory requirements are satisfied. One of the witnesses must be a Law Society licensee.Clients considering remote execution should ensure that all legal requirements are followed carefully.Final Thoughts The validity of a will depends not only on its contents but also on how it is executed.By using independent witnesses, following the requirements of the Succession Law Reform Act, and preserving evidence of proper execution through an Affidavit of Execution, testators can help reduce future challenges and probate complications.While a will does not need to be notarized to be valid in Ontario, professional assistance from a lawyer or notary can help ensure that the signing process is properly documented and that important supporting documents are completed at the same time.Case Law: Estate of Madge Linton, 2019 ONSC 7054 — The Presumption of Due ExecutionA useful Ontario Superior Court of Justice decision illustrating the importance of proper will execution is Estate of Madge Linton, 2019 ONSC 7054. The case demonstrates that the law requires a will to be properly witnessed, but it also recognizes that a properly executed will does not necessarily become invalid simply because the witnesses later have no recollection of the signing.The facts Madge Olive Linton died in 2018. After her death, her husband located a will dated November 25, 2014. The will contained the signatures of the testator and two attesting witnesses.The difficulty arose because the two witnesses would not provide affidavits of execution. When required to attend court, both witnesses acknowledged that the signatures appearing beside their names were theirs, but neither could remember witnessing Madge sign the will.The estate therefore had to bring an application to prove the will in solemn form. The court had to determine whether the statutory requirements for execution had been satisfied.The statutory requirements Justice Woodley reviewed section 4 of Ontario's Succession Law Reform Act, which provides that, subject to the statutory exceptions:

the will must be signed at its end by the testator;

the testator must make or acknowledge the signature in the presence of two or more attesting witnesses who are present at the same time; and two or more of those witnesses must subscribe the will in the presence of the testator. The Court also noted that, where witnesses are required, no particular form of attestation is necessary.

The estate trustee bears the burden of proving due execution, on a balance of probabilities.The importance of the attestation clause The 2014 will contained a conventional attestation clause stating, in substance, that the testator had signed and declared the document to be her last will in the presence of both witnesses, who were present together and who then signed as witnesses in the presence of the testator and one another.Although neither witness could remember the signing, both acknowledged that the signatures appearing on the will were theirs. Their addresses and occupations were also correctly recorded.The Court therefore had documentary evidence consistent with a properly executed will.The presumption of due execution The most important aspect of Linton is the Court's treatment of the witnesses' lack of memory.Justice Woodley held that the fact that witnesses cannot remember witnessing the execution of a will is not, by itself, fatal to the validity of the will.Where a will appears on its face to have been properly executed, a presumption of due execution arises unless there is evidence sufficient to rebut that presumption.The Court concluded that the witnesses' lack of recollection did not establish that the required witnessing procedure had not occurred. Their inability to remember the event years later was not an alternative account of what actually happened.The Court relied on the earlier Ontario Court of Appeal decision Re Laxer, 1963 CanLII 153 (ON CA), emphasizing the practical reason for the presumption: the validity of a person's testamentary wishes should not ordinarily depend upon the accuracy of a witness's memory many years after the signing.Justice Woodley ultimately found that the presumption of due execution applied and ordered that Madge Linton's 2014 will be proven in solemn form.Why this case matters for will witnessing in Ontario Linton is significant for several reasons.First, it confirms the importance of complying with the formal requirements in section 4 of the Succession Law Reform Act. The case should not be read as saying that witnesses are unnecessary. The opposite is true: the will in question was required to satisfy the statutory witnessing requirements.Second, the case demonstrates the evidentiary importance of a properly prepared attestation clause. Although an attestation clause is not itself a substitute for the statutory requirements, a conventional clause recording that the testator signed or acknowledged the will in the presence of two witnesses can provide important evidence concerning proper execution.Third, the decision demonstrates that a witness's later lack of memory does not automatically invalidate a will. The Court distinguished between evidence that the statutory requirements were not followed and a witness simply being unable to remember an event that occurred years earlier.Fourth, the case illustrates why careful execution procedures remain important in professional practice. If the testator, both witnesses, and the person supervising the execution properly follow the statutory requirements and the document contains an appropriate attestation clause, there may be substantially better evidence of due execution if questions arise after the testator's death.Practical significance for notaries and lawyers For lawyers and notaries involved in the execution of wills, Linton provides a useful practical lesson: the execution ceremony should be treated as an important evidentiary event, not merely as the act of obtaining signatures.The safest practice is to ensure that the testator and both witnesses are together when the required signing or acknowledgment occurs, that the witnesses sign in the testator's presence, and that the execution is accurately documented.The case also helps explain why practitioners generally take care to record the identity of the witnesses and to use a clear attestation clause. If a dispute arises years later, the original will and the circumstances recorded at the time of execution may become important evidence.At the same time, Linton should not be interpreted as permitting informal execution of wills. The Court's conclusion rested on its finding that the will appeared properly executed and that the evidence did not rebut the presumption of due execution. It was not a decision dispensing with the statutory requirement for two witnesses.A particularly important distinction The case is also useful in explaining the difference between execution of a will and proving execution after death.The two witnesses were required at the time the will was executed because Ontario law requires two attesting witnesses for an ordinary formal will. Their later involvement is an evidentiary matter. If they are unavailable, unwilling, or unable to remember the signing, the court may have to determine whether the available evidence establishes due execution.Thus, the witness requirement exists at the time of execution; the witness's later affidavit or testimony is evidence used to establish what occurred.That distinction is particularly important in professional will practice.Conclusion Estate of Madge Linton, 2019 ONSC 7054 is therefore a strong Ontario authority for the proposition that a will that appears to have been properly executed benefits from a presumption of due execution, and that a witness's failure to remember the signing years later does not, without more, defeat the will.The case reinforces the central importance of the two-witness requirement under Ontario's Succession Law Reform Act, while also demonstrating the evidentiary protection provided by careful and properly documented execution.For practitioners, the lesson is straightforward: use two competent attesting witnesses, ensure the statutory signing requirements are actually followed, and document the execution carefully. Proper execution at the outset can substantially reduce evidentiary difficulties when the will must later be proved.Disclaimer This article provides general information about Ontario wills and witnessing requirements. Home-Based Notary Services: Professional, Convenient, and Cost-EffectiveMany people picture legal services being provided from a large downtown office with reception staff, waiting rooms, and rows of offices. As a result, some clients are surprised when they learn that a notary public operates from a home office or meets clients by appointment in a building lobby or other convenient location.The reality is that the legal profession has changed significantly over the past decade. Advances in technology, secure electronic communication, virtual meetings, and digital document management have enabled many lawyers, paralegals, consultants, and notaries to operate successfully from home-based offices while maintaining the same professional standards expected of traditional commercial offices.Home Offices Are Common in the Legal ProfessionThe Law Society of Ontario recognizes that many lawyers and paralegals now work remotely or from home-based offices. The Law Society even provides guidance specifically addressing home offices and remote workspaces, acknowledging that legal professionals can provide quality services while meeting all professional obligations, including client confidentiality and secure record keeping. The focus is not on where services are provided, but whether professional standards are maintained.According to the Law Society of Ontario's 2024 Annual Report, Ontario has more than 45,000 practising lawyers and over 4,300 paralegals providing legal services. The legal profession has increasingly adopted flexible and remote work arrangements, particularly since the pandemic.A survey of Canadian lawyers found that 74% reported an increase in remote work among their colleagues, reflecting a significant shift in how legal services are delivered.Why Many Notaries Choose a Home OfficeOperating a home-based practice allows a notary to focus resources on client service rather than expensive commercial overhead.Commercial office space in Toronto can be costly. Rent, utilities, reception staffing, office maintenance, parking, and other expenses can add thousands of dollars each month to operating costs. Those expenses are often passed on to clients through higher fees.By maintaining a home-based office, many notaries can:Offer competitive pricing Provide flexible appointment times Reduce unnecessary overhead Spend more time serving clients rather than managing office administration Offer mobile and after-hours services Benefits for Clients Lower Costs One of the biggest advantages for clients is affordability. A home-based notary often has lower operating expenses than a traditional commercial office, allowing savings to be passed on to clients.Flexible Scheduling Clients frequently need documents notarized outside traditional business hours. Home-based notaries often have greater flexibility to accommodate evening, weekend, and urgent appointments.Personalized Service Many clients appreciate dealing directly with the notary rather than navigating multiple staff members or waiting in a busy reception area.Convenient Appointments Not every notarization requires a large office setting. Many clients simply need a certified true copy, affidavit, statutory declaration, travel consent letter, or power of attorney witnessed efficiently and professionally.Why Meetings May Take Place in a Building Lobby Some clients wonder why a notary may choose to meet in a building lobby rather than invite clients directly into a private residence.There are practical reasons for this:Enhanced security for both parties Professional and neutral meeting environment Convenience and accessibility Respect for personal privacy Efficient document review and signing Meeting in a lobby does not reduce the professionalism of the service. The same legal requirements for identity verification, witnessing, document review, and record keeping continue to apply.What Matters Most When choosing a notary public, the most important questions are not whether the office is located in a commercial tower or a home office.Instead, clients should ask:Is the notary properly appointed? Is identity verified according to legal requirements? Are documents reviewed carefully? Is confidentiality maintained? Is the service professional, accurate, and reliable? Professionalism is measured by competence, integrity, and service quality—not by the size of an office.At New Horizons Notary Services, our goal is to provide professional, affordable, and convenient notarial services while maintaining the high standards expected of Ontario notaries. Whether you require certified true copies, affidavits, statutory declarations, powers of attorney, travel consent letters, or other notarial services, we are committed to delivering efficient and reliable service tailored to your needs.Sources Law Society of Ontario guidance on home offices and remote workspaces. Law Society of Ontario 2024 Annual Report (45,109 practising lawyers and 4,332 paralegals providing legal services). Canadian legal profession survey reporting increased remote work among lawyers

Applying for a Canadian Passport: Understanding Guarantors, the "In Lieu of Guarantor" Form, and the Notary’s Role
Applying for a Canadian passport can feel overwhelming — especially when clients arrive at my office expecting me to act as their guarantor. As a licensed Notary Public and Commissioner of Oaths in Ontario, I frequently see this confusion. Many people believe a notary can serve as a guarantor or fully handle the entire passport application. Unfortunately, that is not correct.In this guide, I explain the passport application process in Canada, the guarantor requirement, when and how to use the Statutory Declaration in Lieu of Guarantor, and exactly what a notary can (and cannot) do to help you.1. Do You Need a Guarantor for a Canadian Passport? Yes — in most cases.According to the official Government of Canada website, a guarantor is required for most adult passport applications submitted within Canada. The guarantor must:Be a Canadian citizen Be 18 years or older Have known you personally for at least 2 years Hold a valid 5- or 10-year Canadian passport (not expired for more than 1 year) The guarantor must personally sign:Your passport application form The back of one of your passport photos (“I certify this to be a true likeness of…”) Photocopies of your supporting identity documents (if you are not submitting originals) Important: A Notary Public cannot act as your guarantor simply because they are a notary. The guarantor role is personal and based on knowing you for two years.2. What If You Don’t Have a Guarantor? If you cannot find an eligible guarantor, you must complete the Statutory Declaration in Lieu of Guarantor (Form PPTC 132).This form is not available online. You must request it by:Visiting a Passport Canada office in person, or Contacting the Passport Program by phone or mail Once you have the form, you must:Fill it out (but do not sign it yet) Bring it, along with your passport photos and supporting documents, to a Notary Public or Commissioner of Oaths Swear/declare the information in front of the notary The notary will then:Witness your signature on the declaration Certify your passport photos (by signing the back and writing “I certify this to be a true likeness…”) Certify photocopies of your identity documents (if required) 3. The Notary’s Role in Passport Applications As a Notary Public in Ontario, I can help with the following:I CAN:Witness and notarize the Statutory Declaration in Lieu of Guarantor Certify your passport photos as a true likeness Certify photocopies of your supporting identity documents Administer oaths or declarations required for the application I CANNOT:Act as your guarantor Provide legal advice about your passport application Guarantee that the Government of Canada will approve your application 4. Step-by-Step Process Most Clients Follow Complete the passport application form (PPTC 140 for adults). Get two identical passport photos taken. Try to find an eligible guarantor. If unsuccessful, request Form PPTC 132. Book an appointment with a notary public. Bring:Completed application form Original identification documents Two passport photos Completed (unsigned) Statutory Declaration in Lieu of Guarantor (if applicable) The notary will witness your signature and certify the photos/documents. Submit everything to a Passport Canada office or by mail. Final Advice Many clients come to my office expecting a quick stamp and signature, only to discover they need a guarantor or the special declaration form. Planning ahead saves time and stress.If you’re applying for a Canadian passport and don’t have a guarantor, feel free to contact me. I can notarize the Statutory Declaration in Lieu of Guarantor and certify your photos and documents properly.Need help with your passport documents? The Forensic Notary: Mental and Psychological Competence in Notarial PracticeAs a paralegal professor with over 15 years of teaching experience and a practicing Notary Public & Commissioner of Oaths in Toronto, I have observed a common tendency in our profession: many notaries focus primarily on the transactional aspects — the signing, the stamp, and the fee — while underestimating the mental and psychological demands of the role.True competence as a notary goes far beyond technical proficiency. It requires mental and psychological readiness to navigate the wide range of emotional states, pressures, and unexpected situations clients bring to the table. I refer to this deliberate, investigative, and psychologically aware approach as the Forensic Notary mindset — a philosophy I have developed and refined through years of hands-on practice.Understanding the Human Element While most clients are reasonable and well-prepared, some present with high stress, emotional distress, cognitive confusion, or subtle signs of duress or coercion. Others arrive with unusual or unexpected circumstances that demand careful attention.Peer-reviewed literature in forensic psychology and legal practice strongly supports the importance of psychological awareness in such interactions. For example, research on lawyer-client and professional-client relationships consistently highlights that empathy, active listening, and rapport-building significantly improve trust, encourage open communication, and reduce misunderstandings (Elbers et al., 2012). Desirable characteristics identified in legal professionals include strong communication skills, empathy, and expertise.In the context of capacity assessment — critical for many notarial acts such as Powers of Attorney — studies emphasize the need to evaluate whether a person understands the nature and consequences of the document they are signing (see guidelines and reviews on decisional capacity in legal settings, including works drawing on Grisso’s model for functional, causal, and interactive components of capacity).My Two-Tier Intake Process To uphold both legal standards and ethical responsibility, I use a structured two-tier intake process:Initial Phone Interview — Before confirming an appointment, I gather detailed information about the documents and circumstances. This helps identify potential complexity or red flags early. In-Person Forensic Assessment — During the meeting, I engage in careful, open-ended questioning while observing body language, consistency of responses, signs of understanding, and any indicators of duress or confusion. I examine originals closely — security features, handwriting, signatures — sometimes using magnification. Throughout, I clearly state my role: “I am acting strictly as a Notary Public. I do not provide legal advice. If you require independent legal advice, you should consult a lawyer or licensed paralegal.”This approach aligns with Ontario’s legal requirements under the Notaries Act and Commissioners for Taking Affidavits Act, as well as best practices in capacity assessment, which stress the importance of verifying understanding and voluntariness (see resources on mental capacity from Ontario’s Substitute Decisions Act framework and related forensic psychology literature).Why “Personable” Matters Clients frequently describe me in reviews as both professional/trustworthy and personable. To me, this is significant. Being personable while maintaining strict boundaries is not casual friendliness — it is a deliberate skill that helps create psychological safety, encouraging clients to share necessary details without feeling judged or rushed.Research supports that empathy and rapport in professional-client interactions foster trust and more complete disclosure (Gerdy, 2008; various studies on therapeutic jurisprudence and lawyer-client dynamics). However, this must always be balanced with clear ethical limits: a notary is not a lawyer or psychologist.I treat every client and document as if it were my own. This means investing mental energy to understand the person, their relationship to the document, and any potential issues — all while remaining firmly within the notary’s role. Simple conversational questions often reveal important information about linguistic competence, mental stability, and voluntariness.Beyond Being a “Signature Robot” Being a notary is not merely stamping documents. It involves careful scrutiny to protect the integrity of the process — checking for red flags such as pressure to sign quickly, missing originals, or signs of possible fraud. Forensic document examination principles reinforce the value of close inspection of security features and signer behavior.By combining rigorous notarial standards with psychological observation and investigative diligence, we elevate the profession. We move from being mechanical signers to responsible guardians of authentic legal acts.I invite fellow notaries, lawyers, paralegals, and clients to reflect on the human side of this work. Mental and psychological competence is not optional — it is essential for ethical, high-quality service.What challenges have you encountered when dealing with stressed or unusual client situations? How do you balance professionalism with human connection?
